Atmel Corporation’s Simply AVR Design Contest Rules

 

Term

Atmel Corporation’s Simply AVR Design Contest begins March 31, 2014, and ends October 17, 2014, at 11:59 pm Pacific Standard Time. By submitting an entry, each entrant agrees to the rules of the Contest and represents that he or she is 18 years old or older.

 

Who may Enter

This Contest is open to any person who is:

  1. 18 years old or older;
  2. Not (a) an employee or contractor of Atmel Corporation, (b) a member of the immediate family of such an employee or contractor, or a person residing with such an employee or contractor), or (c) an employee or internally contracted vendor of any government or government-affiliated company or organization; and
  3. Not a resident of Italy, Cuba, Iran, Syria, North Korea, Myanmar (formerly Burma), Sudan, the province of Quebec in Canada, or anywhere this Contest is prohibited or limited under local law.

Atmel has sole discretion to determine winners’ eligibility. NO PURCHASE IS NECESSARY TO WIN.

 

Contest Entries

Entrants must design a device of any sort – a gadget or a gizmo – that is based on any product in the Atmel AVR product line and is capable of commercial exploitation. Each entry must include answers to the following questions:

  • What did you make?
  • How did you make it?
  • Where did you make it?
  • What parts and tools did you use?
  • How does it work?
  • What makes AVR easy to use?
  • How would you make your masterpiece available to the masses?

Each entry must also include video footage in a YouTube- or Vimeo- compatible format of a working prototype, and a plan for scaling the Device for mass production. Additionally, each entry must:

  1. Be the original design of the entrant and not have been entered in any other contest or otherwise be distributed commercially;
  2. If incorporating the recognizable image of a specific person, be accompanied by an executed model release, valid in the jurisdiction of residence of the person whose image is incorporated, from that person (or from that person’s parent or guardian if that person is less than eighteen (18) years old); and
  3. Not infringe any other person’s intellectual property rights, including but not limited to patents.
 

How to Enter

Entrants may submit entries at  http://app.snapapp.com//simplyavrcontest (the "Contest Website"). Entries must include the following in the body of or as an attachment to the entry:

  1. Entrant name
  2. Email address
  3. Country
  4. The name given to the Device
  5. A brief text description of the Device’s functionality and use (for display on the Internet)
  6. A video clip (5 minutes or less) in a YouTube-compatible format describing the Device's design, functionality and use scenarios; and

No entries will be accepted through the mail or otherwise delivered in any form other than electronic file submitted to the Contest Website. Contest entries become Atmel's property upon their receipt and will not be returned to the entrants. There is no fee to enter the Contest.

 

Conduct of the Contest

The Contest will be conducted as follows:

  1. When submitted, each entry will be posted for public review and voting at the Contest Website.
  2. The public will vote on each entry using the voting mechanisms found at the Contest Website.
  3. The Contest judges will review the five entries receiving the greatest number of favorable votes from the public at the Contest Website.
 

Judging Criteria

All entries will be judged using the following criteria:

  1. Quality of the idea (including originality and creativity and whether the Device design is substantially different from current market offerings) (30%);
  2. Quality of the Device design (including thoroughness of product design documentation submitted; the degree to which the product’s visual appeal and user experience are demonstrated;
  3. Commercial potential (including feasibility of production, material and production costs, scalability, and potential demand) (10%); and
  4. Number of public votes received (50%).

The judges will be designated Atmel employees, whose decisions will be final. Atmel will announce the Grand Prize Winner by the first week of October 2014. Atmel also will notify the Grand Prize Winner by email by the same date.

 

Prizes

There will be one Grand Prize Winner and four Runners-Up. The Grand Prize Winner will receive $1500 in cash. Each Runner-Up will receive $500 in cash.

 

License to Use Entries

Entrants will continue to own all intellectual property rights in the Devices. However, by entering the Contest, entrants grant Atmel and its parent, subsidiary, and affiliate corporations a royalty-free, worldwide, perpetual, non-exclusive license to display, distribute, reproduce and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any purpose whatsoever. Beyond the prize provided to the Grand Prize Winner and the four Runners-Up, Atmel will not pay any additional consideration for the license described in this provision.

 

General

The Contest is void where prohibited or restricted by law, including applicable export controls laws. To the greatest extent permitted by applicable law, Atmel reserves the rights to (1) cancel the Contest or modify these rules at its discretion and without prior notice, or (2) substitute another prize of equivalent or greater monetary value for any prize; or (3) disqualify any entry for any reason, without notice to the entrant.

The Grand Prize Winner and each Runner-Up is responsible for paying any taxes owed upon receipt of the prizes. Atmel will issue a valuation document for taxing authorities to the Grand Prize winner and each Runner-Up.

The Grand Prize Winner and each Runner-Up must sign an affidavit of eligibility and a license as provided above. As a condition of awarding a prize, Atmel may require the Grand Prize Winner and each Runner-Up to agree to the use of his or her name, voice, and likeness for the purposes of advertising, trade, or promotion without further compensation, unless prohibited by law. The Grand Prize Winner’s or a Runner-Up’s failure to execute the required documentation within ten (10) days after receipt will result in disqualification and Atmel may select a substitute prize recipient from the remaining eligible entries. Atmel is not responsible for and will not be liable for late, lost, misdirected, or unsuccessful efforts to notify the winner.

BY ENTERING THE SWEEPSTAKES, ENTRANTS ACKNOWLEDGE THAT THE PRIZE IS AWARDED ON THE CONDITION THAT ATMEL AND ITS PARENT, SUBSIDIARY, AND AFFILIATE CORPORATIONS AND ITS AGENTS, REPRESENTATIVES, AND EMPLOYEES WILL HAVE NO LIABILITY WHATSOEVER FOR THE ENTRANTS’ SUBMISSION OF CONTEST ENTRIES, THE CONDUCT OF THE CONTEST, AND THE AWARD OR USE OF THE PRIZE. TO THE EXTENT PERMITTED BY LAW, THE GRAND PRIZE WINNER AND RUNNER-UP RELEASES ATMEL AND ITS PARENT, SUBSIDIARY, AND AFFILIATE CORPORATIONS AND ITS AGENTS, REPRESENTATIVES, AND EMPLOYEES FROM ALL CLAIMS ARISING BY VIRTUE OF HIS OR HER ENTRY INTO THE SWEEPSTAKES AND USE OF THE PRIZE.

To the extent permitted by law, these rules shall be interpreted, and this Contest shall be conducted, in accordance with California law, without giving effect to choice of law provisions. All disputes concerning these rules and this Contest shall be adjudicated in the federal or state courts having jurisdiction over Santa Clara County, California, USA. If any provision in these rules is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law.
